Murphy Applauds President Trump's Elimination of China's De Minimis Privilege

February 5, 2025

Washington, D.C. — Congressman Greg Murphy, M.D. issued the following statement in response to the Trump Administration's enactment of additional tariffs on China, including suspending the de minimis privilege.

"President Trump is taking bold action to ensure America is not ripped off in our trade relationship with China," said Congressman Greg Murphy, M.D. "I am particularly grateful to see that the de minimis privilege, which allows Chinese companies to avoid paying duties on goods under $800 has been suspended. We must ensure a fair playing field for American businesses to compete and end the abuse of our trade laws."

Background
Under current law, goods valued at under $800 are free of duty, and of any tax, if a shipment is imported by one person to another on the same day. Many Chinese firms have avoided paying these tariffs on imports less than $800 in value as a result of the de minimis privilege.

Murphy introduced the End China’s De Minimis Abuse Act on January 28th to end the use of the privilege on goods subject to Section 301, 201, and 232 tariffs. It also added a new 10-digit Harmonized Tariff System (HTS) classification requirement for all de minimis entries and strengthened penalties on violations.
